根据国家有关法律、法规和本市有关规定,甲、乙双方在平等自愿的基础上,经友好协商,就甲方将其合法拥有的房屋出租给乙方使用,乙方承租使用甲方房屋事宜,订立本合同。
Party A and B have reached an agreement through friendly consultation to conclude the following contract.
1、房屋地址Location of the premises
甲方将其所有的位于__________________________________________的房屋及其附属设施在良好状态下出租给乙方作_______使用。
Party A will lease to Party B the premises and attached facilities owned by itself, which is located at__________________________________________on for _________.
2、房屋面积Size of the premises
出租房屋的登记面积为_________平方米(建筑面积)。
The registered size of the leased premises is_____quare meters (Gross size).
3、租赁期限Lease term
租赁期限自_____年____月____日起至______年____月____日止,甲方应于______年_____月_____日前将房屋交付乙方使用。

4、租金Rental
1)、金额:双方商定月租金为______,付费方式为_________,提前____天支付下一期租金。
Amount:the rental will be RMB______per month. Payment of rental will be one installment every_______month(s), Each successive installment will be paid______days before the starting date of successive period.
5、押金Deposit
1)、为确保房屋及其附属设施之安全与完好,及租赁期内相关费用之如期结算,乙方同意于______年_____月______日前支付给甲方押金_________元整,甲方在收到押金后予以书面签收。
Guarantying the safety and good conditions of the premises and attached facilities and account of relevant fees are settled on schedule during the lease term, party B will pay_____________________ to party A as a deposit before________(month)_________ (day)_________ (year). Party A will issue a written receipt after receiving the deposit.
2)、除合同另有约定外,甲方应于租赁关系解除或者在合同解除日且乙方点清并付清所有应付费用后搬出的当天将押金全额无息退还乙方。
Unless otherwise provided for by this contract, Party A will return full amount of the deposit without interest on the day when this contract expires or on the day when this contract is cancelled.and party B clears the premises and has paid all due rental and other expenses.
3)、因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用,甲方可在押金中抵扣,不足部分乙方必须在接到甲方付款通知后十日内补足。
In case party B breaches this contract, party A has right to deduct the default fine, compensation for damage or any other expenses from the deposit. In case the deposit is not sufficient to cover such items, Party B should pay the insufficiency within ten days after receiving the written notice of payment from Party A.
4)、因甲方原因导致乙方无法在租赁期内正常租用该物业,甲方应立即全额无息退还押金给乙方,且乙方有权追究甲方的违约责任。并且甲方需要适当的支付乙方必要的损失。
If Party B can’t normally use the apartment because of Party A , Party A should return the deposit to Party B at once. And,Party A should pay the reasonable compensation required by Party B.
6、甲方义务Obligations of Party A .
1)、甲方须按时将房屋及附属设施(详见附件)交付乙方使用。
Party A will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to Party B for using.
2)、房屋设施如因质量原因、自然损耗、不可抗力或意外事件而受到损坏,甲方有修缮并承担相关费用的责任。如甲方未在两周内修复该损坏物,以致乙方无法正常使用房屋设施,乙方有权终止该合约,并要求退还押金。
In case the premise and attached facilities are damaged by quality problems, natural damages or accidents, Party A will be responsible to repair and pay the relevant expenses. If Party A can’t repair the damaged facilities in two weeks so that Party B can’t use the facilities normally, Party B has the right to terminate the contract and Party A must return the deposit.
3)、甲方应确保出租的房屋享有出租的权利,如租赁期内该房屋发生所有权全部或部分转移、设定他项物权或其他影响乙方权益的事件,甲方应保证所有权人、他项权利人或其他影响乙方权益的第三者能继续遵守本合同所有条款,反之如乙方权益因此遭受损害,甲方应负赔偿责任。
Party A will guarantee the lease right of the premises. In case of occurrence of ownership transfer in whole or in part and other accidents affecting the right of lease by party B, party A shall guarantee that the new owner and other associated, third parties shall be bound by the terms of this contract. Otherwise, Party A will be responsible to compensate party B’s losses.
7、乙方义务Obligations of Party B
1)、乙方应按合同的规定按时支付租金及押金。
Party B will pay the rental and the deposit on time.
2)、乙方经甲方同意,可在房屋内添置设备。租赁期满后,乙方将添置的设备搬走,并保证不影响房屋的完好及正常使用。
Party B may add new facilities with Party A’s approval. When this contract expires, Party B may take away the added facilities without changing the good conditions of the premises for normal use.
3)、未经甲方同意,乙方不得将承租的房屋转租或分租。
Party B will not transfer the lease of the premises or sub without Party A’s approval.
4)、乙方应按本合同规定合法使用该房屋,不得擅自改变使用性质。乙方不得在该房屋内存放危险物品。否则,如该房屋及附属设施因此受损,乙方应承担全部责任。
Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. Otherwise, Party B will be responsible for the damages caused by it.
5)、乙方应承担租赁期内的水、电、煤气、电话费、宽带费、物业管理费和电视费等一切因实际使用而产生的费用,并按单如期缴纳。
Party B will bear the cost of utilities such as telephone communications, water, electricity, Gas,management fees,internet and cable television on time during the lease term.
6)、乙方应爱护租用的房屋及其设备,严格按专门的使用要求使用,如因乙方人为使用不当而导致损坏,乙方负责赔偿及修复费用,乙方必须做到:
Party B must take care of the property and its contents, and use them exactly according to the specific instructions; otherwise Party B should pay for the compensation and repairing fees to Party A for its improper use of the property. Party B must do as follows:
6.1 足够经常清洁房屋,复合地板、木地板、地毯、瓷砖地面要按不同要求清洁;
Do regularly clean the house. Clean the laminate floor, the parquet floor, the carpet, and the tile correctly according to the specific instructions.
6.2足够经常通风、开足空调(特别是在雨季、冬天)以避免冷凝水损坏房屋,导致霉变;
Do regularly open the window and ventilate with the air conditioner (especially in rainy season and winter) in the house, in order to prevent the condensation water from damaging the house and going mouldy.
6.3 足够经常清洁厨房、炉灶等电器;
Keep the kitchen clean, such as electric apparatuses.
6.4 浴缸、冲淋房、洗菜盆的排水口必须使用专门的滤网阻止头发、硬物等进入排污管,抽水马桶内不能倒其它杂物进入,疏通下水道的费用由乙方承担。
The outlet of bathtub, the shower, and the basin must be added special network to prevent the hair, hard things, etc. from getting into the pipeline. Mess and other things cannot be poured into the toilet bout. The fee for unchoking the sewer will be borne by Party B.
6.5 日常损耗物品及维修由乙方承担更换费用(比如挂取窗帘、疏通下水道、换灯泡等)
The normal wear & tear fees of the property shall be borne by Party B (Such as hanging and fetching curtains, unchoking the sewer, changing the bulb etc).
7)、乙方如长期或经常不在,乙方必须安排人员看管房屋,刮风下雨时关好门窗,经常通风、开足空调,还必须保证甲方及代理人能及时实施紧急和必要的维修修复工作,否则,造成的损失由乙方负责。
If Party B is out regularly or for a long time, Party B must arrange someone to look after the leased property. Make sure the doors and the windows are closed when blowing and raining, often ventilate the house, run the air conditioner, and guarantee for Party A and the Agent to make implement urgent and essential maintenance. Otherwise, the losses caused should be borne by Party B.
8.中介方义务:Obligations of Intermediary
1)督促双方提供必要的证明文件,对出租方而言,需提供房产证(或者相关的证明性文件)及身份证复印件;对承租方而言,需提供身份证复印件或公司营业执照复印件。
Supervision both sides provide the essential proof document, speaking of hires the side, must provide the real estate property card (or correlation certificate document) and the status card duplicate press work; Speaking of rents the side, must provide the status card duplicate press work or the company does business the license duplicate press work.
2) 中介方提供的服务期与合同期一致
The service of intermediary is available during the contract period.
9.合同终止及解除的规定Termination and dissolution of the indenture
1)、乙方在租赁期满后如需续租,应提前一个月通知甲方,由双方另行协商续租事宜。在同等条件下乙方享有优先续租权。在合同期内,甲乙双方均不得擅自解除合同,如一方因故需解除合约,需提前一个月向另一方以书面形式提出终止请求,并赔偿另一方相当于一个月租金的违约金。如甲方提出终止请求,应退回剩余的房屋租金给乙方。
Within one month before the contract expires, Party B will notify Party A if it intends to extend the lease. In this situation, two parties will discuss matters over the extension. Under the same terms Party B has the priority to lease the premises. In contract period, both Party A and Paty B cannot relief this contract without authorization, if any one party needs to cancel this contract, this party must notify another party by writing at least one month before the intended termination, and this party must pay one months rent to another party as compensation. If Party A needs cancel this contract, Party A must return surplus rent which Party A was received to Party B.
2)、本合同一经双方签字后立即生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。
This contract will be effective after being signed by both parties. Any party has no right to terminate this contract without both party’s agreement. Anything not covered in this contract will be discussed separately by both parties.
10、违约及处理Breach of the contract
1)、甲、乙双方任何一方在未征得对方谅解的情况下,不履行本合同规定条款,导致本合同中途终止,则视为该方违约,双方同意违约金为______元整,若违约金不足弥补无过错方之损失,则违约方还需就不足部分支付赔偿金。
During the lease term, any party who fails to fulfill any article of this contract without the other party’s understanding will be deemed to breach the contract. Both parties agree that the default fine will be______. In case the default fine is not sufficient to cover the loss suffered by the faultless party, the party in breach should pay additional compensation to the other party.
2)、若双方在执行本合同或与本合同有关的事宜发生争议,应首先友好协商;协商不成,可向有管辖权的人民法院提起诉讼。
Both parties will solve the disputes arising from execution of the contract or in connection with the contract through friendly consultation. In case the agreement cannot be reached, any party may submit the dispute to the court that has the jurisdiction over the matter.
11、其他Miscellaneous
1) 合同签定之日,甲方按本合同月租金的50%,一次性向丙方支付中介信息服务费,即______元,大写 .

四、 租金 Rental

Party B will pay the rental before using the premises and attached facilities (In case Party B pays the rental in the form of remittance, the date of remitting will be the day of payment and the remittance fee will be borne by the remitter.) 3. 如乙方逾期支付租金超过十天,则每天以月租金的0.5%支付滞纳金;如乙方逾期支付租金超过十五天,则视为乙方自动退租,构成违约,甲方有权收回房屋,并追究乙方违约责任。
In case the rental is more than ten working days overdue, Party B will pay 0.5 percent of monthly rental as overdue fine every day, if the rental be paid 15 days overdue, Party B will be deemed to have with drawn from the premises and breach the contract. In this situation, Party A has the right to take back the premises and take actions against party B's breach.
五、 保证金 Deposit
1. 为确保房屋及其附属设施之安全与完好,及租赁期内相关费用之如期结算,乙方同意于______年_____月_____日前支付给甲方保证金人民币 _________元整,甲方在收到保证金后予以书面签收。

Party A will issue a written receipt after receiving the deposit.
2. 除合同另有约定外,甲方应于租赁关系消除且乙方迁空、点清并付清所有应付费用后的当天将保证金全额无息退还乙方。
Unless otherwise provided for by this contract, Party A will return full amount of the deposit without interest on the day when this contract expires and party B clears the premises and has paid all due rental and other expenses.
3. 因乙方违反本合同的规定而产生的违约金、损坏赔偿金和其它相关费用,甲方可在保证金中抵扣,不足部分乙方必须在接到甲方付款通知后十日内补足。
In case party B breaches this contract, party A has right to deduct the default fine, compensation for damage or any other expenses from the deposit . In case the deposit is not sufficient to cover such items, Party B should pay the insufficiency within ten days after receiving the written notice of payment from Party A.
六、 甲方义务 Obligations of Party A
1. 甲方须按时将房屋及附属设施(详见附件)交付乙方使用。
Party A will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to Party B for using.
2. 房屋设施如因质量原因、自然损耗或灾害而受到损坏,甲方有修缮并承担相关费用的责任。
In case the premise and attached facilities are damaged by quality problems, natural damages or disasters, Party A will be responsible to repair and pay the relevant expenses.
3. 甲方应确保出租的房屋享有出租的权利,反之如乙方权益因此遭受损害,甲方应负赔偿责任。
Party A will guarantee the lease right of the premises. Otherwise, Party A will be responsible to compensate Party B's losses.
七、 乙方义务 Obligations of Party B
1. 乙方应按合同的规定按时支付定金、租金及保证金。
Party B will pay the rental, the deposit and other expenses on time.
2. 乙方经甲方同意,可在房屋内添置设备。租赁期满后,乙方将添置的设备搬走,并保证不影响房屋的完好及正常使用。
Party B may decorate the premises and add new facilities with Party A's approval. When this contract expires, Party B may take away the added facilities which are removable without changing the good conditions of the premises for normal use.
3. 未经甲方同意,乙方不得将承租的房屋转租或分租,并爱护使用该房屋如因乙方过失或过错致使房屋及设施受损,乙方应承担赔偿责任。
Party B will not transfer the lease of the premises or sublet it without Party A's approval and should take good care of the premises. Otherwise, Party B will be responsible to compensate any damages of the premises and attached facilities caused by its fault and negligence.
4. 乙方应按本合同规定合法使用该房屋,不得擅自改变使用性质。乙方不得在该房屋内存放危险物品。否则,如该房屋及附属设施因此受损,乙方应承担全部责任。
Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. Otherwise, Party B will be responsible for the damages caused by it
5. 乙方应承担租赁期内的水、电、煤气、电讯、收视费、等一切因实际使用而产生的费用,并按单如期缴纳。
Party B will bear the cost of utilities such as communications, water, electricity, gas, management fee etc. on time during the lease term.
八、 合同终止及解除的规定 Termination and dissolution of the contract
1. 乙方在租赁期满后如需退租或续租,应提前两个月通知甲方,由双方另行协商退租或续租事宜。在同等条件下乙方享有优先续租权。
Within two months before the contract expires, Party B will notify Party A if it intends to extend the leasehold. In this situation, two parties will discuss matters over the extension.
2. 租赁期满后,乙方应在当天将房屋交还甲方;任何滞留物,如未取得甲方谅解,均视为放弃,任凭甲方处置,乙方决无异议。
When the lease term expires, Party B will return the premises and attached facilities to Party A within days. Any belongings left in it without Party A's previous understanding will be deemed to be abandoned by Party B. In this situation, Party A has the right to dispose of it and Party A will raise no objection.
3. 本合同一经双方签字后立即生效;未经双方同意,不得任意终止,如有未尽事宜,甲、乙双方可另行协商。
This contract will be effective after being signed by both parties. Any party has no right to terminate this contract without another party's agreement. Anything not covered in this contract will be discussed separately by both parties
九、 违约及处理 Breach of the contract
1. 甲、乙双方任何一方在未征得对方谅解的情况下,不履行本合同规定条款,导致本合同中途中止,则视为该方违约,双方同意违约金为人民币___________元整,若违约金不足弥补无过错方之损失,则违约方还需就不足部分支付赔偿金。

租约(LEASE)
对于房客:
1.我刚买了房子,我可以交足下三个月房租后,立即中止合同吗?
不能。租约在终止日期前是有效的。但是,你可以尝试与房东协商或另签一个租约。
2.我是一个没有租约的房客,我可以随时搬出出租房吗?
不管是书面的还是口头的,房客都应有租约。如果没有明确的租房期限,房客必须在搬走前一个月通知房东。
3.与我合租的人搬走了,我可以只交纳我自己那份租金,一直住下去吗?
房东有收取全部房租费的权利。如果只收到一部分,他可以要求终止合约。
4.房客要搬到另外一个城市去,转租房子或重签租约哪种更好?
如果房客不再搬回原住处居住,重签租约更好。
5.房客在租约上签字后,是否有十天的待定时间可以取消租约?
没有。没有任何的待定时间。
6.房客和房东已定了租约,但房客却改变了主意,不想租了。他还要履行其责任吗?
是的,租约就是合同,而合同必须要遵守。
对于房东:
1.我的房客毁约搬走了,我应该怎么办?
房东应通过租给其他人来尽可能地减少损失。房东也有权利向毁约的房客追讨赔偿金来弥补房租损失。
2.房客二年前已毁约,我刚刚发现他。我还能要回他未付的租金吗?
房东有三年的时间在Régie du Logement? 提出申请。
3.房客可以在租住的房子中养狗或猫吗?
可以,除非租约中有禁止此项的条款。
4.房客正在组住我的房子,但我想让我儿子住,我该怎么做?
无论是房东、或其父母、儿子、亲戚想住已足出的房子,房东必须在租约到期日至少六个月前通知房客(如果租约是一年期)。房客有一个月的时间回复。如果房客以书面的形式通知房东不接受此请求,房东则须在提出“恢复权”的申请。
5.房东可以限制出租房内的居住人数吗?
不可以。除非租住的面积有限,证明此限制有道理。
6.房东可以为钥匙或所提供的家具等要求押金吗?
不管是为钥匙或所提供的家具,房东都不能要求押金。
巡视出租房
1.如果房东想巡视房间、检查现状,或想让买房者参观看房,他随时可以进入吗?
不能。房东必须提前24小时通知房客,而且看房时间必须在9:00am 到9:00 pm 之间。
2.如果房东想维修出租房,他能随时做吗?
不能。房东必须提前24小时口头通知房客,而且维修工作时间必须在7:00am 到7:00 pm 之间。
3.如果房东想让继任房客看房子,他能随时进入吗?
不能,房东必须先征得房客同意。
维修
1.洗脸盆(或坐便器)堵了,房东或房客谁承担此项维修费用?
房东须承担此费用,除非房东能证实问题是由房客所致。
2.如果房东疏于做必要得维修,房客有什么追索权?
有很多追索权适用于房客:
降低房租。
搁置房租。
授权房客自己维修。
取消租约。
赔款。
强制命令房东维修。
应由Régie du Logement 决定采取哪一条。
3.房客可以自己维修,然后从房租中扣除该项费用吗?
如果没有授权。房客不能这样做。但以下情况除外:
必要的和紧急的维修。
房客无法联系到房东而告知详情。
交付房租
1.房东须自取房租,还是房客须汇寄房租金给房东?
房东须自取租金,除非双方有其他约定,或二者执行起来都有困难。
2.房客可以用合理理由来推迟缴纳租金吗?
不可以。从当月的第二天起,房东就有权在申请追回租金。
涨房租
1.房客可以拒绝房东涨房租吗?
在收到涨房租通知书后一个月内,房客可以书面的形式拒绝涨房租。
2.如果房客拒绝房东涨房租,房东可以强制要求房客搬出吗?
不可以。如果房客拒绝房东涨房租,房东须到提出申请,修改租约。但如果房子建造或整修不满五年,将是另一种情况。
制定的房租涨幅是多少?
1.并没有制定固定的统一涨幅。每一案例都要分别对待。考虑的因素包括:房租变化、建筑税、市征税、学校税、保险费、能源消耗和保养服务费等。但是,能预估一个平均值。在01/04/2007到02/04/2008期间的涨幅平均值如下:
1.1%-用电取暖的房子。
0.4%--用天然气取暖的房子。
1.4%--用油取暖的房子。
0.8%--不包括取暖的房子。
噪音
